How we handle your personal and health information

Elderhood Enabled is a health service provider. We are bound by the Australian Privacy Principles under the Privacy Act 1988 (Cth) and by the Health Records and Information Privacy Act 2002 (NSW).

Who this policy covers

This policy applies to Elderhood Enabled (ABN 80 700 413 583) and to information collected through this website and through the delivery of our physiotherapy services. It explains what we collect, why, who we share it with, and the choices available to you.

Health service providers do not qualify for the small-business exemption in the Privacy Act 1988 (Cth). We are covered by the Australian Privacy Principles regardless of our size or turnover.

What we collect

Health and other sensitive information

Health information is sensitive information. We collect it only where it is reasonably necessary to provide you with care, and only with your consent — except in the limited circumstances where the law permits or requires collection without consent, such as a serious and imminent threat to someone's life, health or safety.

If you send us information about someone else

Referrers, family members and case managers often contact us about another person. If you provide someone else's personal or health information, please make sure you have their consent, or the authority to act on their behalf. We will treat that information under this policy and, where practical, let the person know we hold it.

How we use it

We do not sell your information, and we do not use it for third-party advertising.

Who we share it with

We disclose personal and health information only where you have consented, where it is directly related to your care and you would reasonably expect it, or where the law requires it. That may include your GP and treating practitioners, your aged-care provider or case manager, a funding body such as DVA or Services Australia, and our professional indemnity insurer or legal advisers where a claim arises.

Storage, and where it is held

This website is hosted by Netlify, and form submissions are delivered to our business email, which runs on Microsoft 365. Clinical records are held in our practice management system. Some of these providers store or process data on servers outside Australia. We take reasonable steps to ensure any overseas recipient handles your information consistently with the Australian Privacy Principles.

Cookies and analytics

This site does not run third-party advertising or tracking scripts, and it does not set marketing cookies. Our hosting provider keeps standard server logs, and we may use search-engine tools that report aggregate, non-identifying traffic data.

Security

We take reasonable steps to protect information from misuse, interference, loss and unauthorised access, including access controls, reputable hosted services and staff obligations of confidentiality. No transmission over the internet can be guaranteed completely secure — if a matter is highly sensitive, please tell us and we will arrange a more secure channel than email.

How long we keep it

Where health information was collected while you were an adult, we retain it for at least seven years from the last occasion a health service was provided to you. Where it was collected while you were under 18, we retain it until you turn 25. These periods are set by the Health Records and Information Privacy Act 2002 (NSW). Enquiry records that do not lead to care are kept only as long as needed, then destroyed or de-identified.

Accessing and correcting your information

You can ask for access to the personal and health information we hold about you, and ask us to correct anything inaccurate, out of date or incomplete. Contact us at admin@elderhoodenabled.com.au or 0423 702 808. We will ask you to verify your identity, and will respond within a reasonable period. Access is provided free or at reasonable cost; in limited circumstances the law allows us to refuse, in which case we will explain why in writing.

Complaints

If you think we have mishandled your information, please raise it with us first at admin@elderhoodenabled.com.au so we can look into it and put it right. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (oaic.gov.au) or, for health information in NSW, the Information and Privacy Commission NSW (ipc.nsw.gov.au).

Changes to this policy

We review this policy from time to time and will publish any updated version on this page.
